Certificate of Conformity to the Technical Regulations of the Customs Union

The Customs Union was initially an agreement between the Russian Federation, the Republic of Belarus and the Republic of Kazakhstan on the special terms of trade between them. At the moment, the Customs Union includes 5 states as Armenia and Kyrgyzstan also joined the agreement.

Trade within the borders of the Customs Union is carried out on the basis of the Agreement on common principles and rules of technical regulation.

The agreement provides for a simplified certification system for products and obtaining authorization for trade in the member countries of the Customs Union. In particular, if a certain type of products is produced in the countries of the Customs Union in compliance with the same requirements, in the same form, if it requires the same procedure for confirming the quality and conformity to the standards and has a corresponding certificate, then this product is allowed for trade in the territory of the mamber states of the Customs Union.

Products that have the Certificate of compliance with the technical regulations of the Customs Union are considered to be in full conformance to the requirements of the technical regulations of the Union and are allowed to circulate within its territory.

The certificate of conformity of the Customs Union has a single form for all states that are members of the Customs Union, and the following data must be provided for obtaining it:

For the Russian manufacturer:

  • Banking details (company card);
  • Founding documents (TIN / OGRN / Articles of Association);
  • Normative document for the manufactured goods (technical conditions or GOST);
  • Name of product;
  • Customs code.

For a foreign manufacturer:

  • Banking details of the applicant company and constituent documents (TIN / OGRN / Charter);
  • Manufacturer's name, address;
  • Name of product;
  • Technical description of the product;
  • FEACN code;
  • The contract of the authorized person between the manufacturer and the applicant.

Registration of the CU TR certificate of conformity:

  • Certificate CU TR is valid throughout the territory of the Customs Union;
  • The certificate may be applied for by a manufacturer, seller or representative of a foreign manufacturer registered in the territory of the Customs Union as a legal entity or an individual entrepreneur;
  • The certificate of the Customs Union can be issued both for a batch of products and for serial production. The maximum validity of the certificate is 5 years;

Registration of the certificate is carried out in the state register, which is a confirmation of its authenticity.

Declaration of Conformity to the Technical Regulations of the Customs Union

The declaration of conformity with the technical regulations of the Customs Union is a document that confirms the compliance of products with the safety requirements defined for this product by the technical regulations of the Customs Union.

Detailed lists of products subject to declaration or certification are specified in the technical regulations of the Customs Union.

For the registration of the CU TR declaration, the following data must be provided:

     For the Russian manufacturer:

  • The main difference between the declaration and certification is that it is the Applicant who accepts the declaration and is responsible for the safety of the declared products, as well as for the reliability of the information specified in the declaration;
  • The CU TR declaration does not provide for a protected government-issued blank, but is drawn up on A4 sheet of paper;
  • The declaration is made in Russian, but may have a duplicate in the language of one of the states of the Union.
